By using the Services, you are agreeing to be bound by this TOU. If you do not agree with this TOU, please do not use the Services.
The Services support the processes of making application, review, decisions, and certificates relating to the process of road authority permitting, and the creation, communication, and sharing of road information.
The Services may continue to evolve, and without notice.
The Services are hosted and supported in Canada.
The Services are web services and are developed for use with current versions of popular web browsers.
Use of the Services
You may use the Services for your organization, for the period your organization has subscribed to the Services, the period your organization is eligible to use the Services because of another party’s subscription, or for a period Transnomis has granted your organization access to the Services.
You may not redistribute, resell or attempt to reverse engineer the Services, or content found in the Services, without the written approval of Transnomis.
You may show the Services to people outside of your organization in support of your professional duties, or as an introduction to the Services; with the understanding that use by other organizations is subject to their subscribing to the Services.
Service Level Commitments
Transnomis takes all reasonable steps to make the Services available to users at least 99.9% of the time during any 30-day period, exclusive of scheduled maintenance.
Transnomis provides support by email at email@example.com, which is sent to the Help Desk and a support request opened.
Transnomis attempts to provide an initial response of 2 hours in cases when the complete Services are not accessible, and follow-up on a regular basis until resolved.
For all other support requests Transnomis attempts to provide an initial response of between 4 hours and 24 hours on a best-efforts basis, depending on the level of severity of the issue affecting the Services.
Transnomis has automated web and application monitoring to help ensure the availability of the Services. Should the Services fail to respond or trigger an alarm condition, automated email notifications are sent to the Transnomis Help Desk to resolve.
Users are encouraged to have two browsers installed on their devices, so that if one browser is not functioning properly, you can use another browser. Primary testing is with the Chrome browser.
Warranties/Disclaimer/Limitations of Liability
There is no other guarantee of Services other than what is stated in the Service Level Commitments.
Transnomis assumes no responsibility for the accuracy or suitability of the content provided in the Services.
Transnomis will not be liable for any direct or indirect losses, damages or costs arising from the use of the Services. You hold Transnomis harmless for your use of the Services.
The Services are provided on an “as is” basis.
Transnomis is not obligated to enforce the TOU.
Your organization is obligated to pay for the services used by your organization; unless paid for by another party or offered without fee by Transnomis.
Your organization is obligated to pay Transnomis for use of the Services that exceeds that which were paid for.
You are obligated to support the integrity of the Services to the benefit of all Transnomis clients, and their users. The accuracy and timeliness of your content is essential.
You are obligated to keep the Services free of personal information, including credit card data.
Grant of Rights
Subject to the Municipal Freedom of Information and Protection of Privacy Act, you grant Transnomis the perpetual right to use in perpetuity the content submitted to the Services to better understand the use of the Services, with the goal of improving the service, and the promotion of the service.
You are under no obligation to use the Services, and you may therefore terminate the use of the Services at any time, and for whatever reason, without notice or refund for any unused Services. You are expected to remove any Content posted to the Services that have not yet expired.
Transnomis reserve the right to discontinue, change or modify features of the Services, in part or entirely, at its sole discretion, and without notice.
Transnomis may change or modify this TOU, in part or entirely, at its sole discretion, and without notice.
Transnomis may terminate your use of the Services at any time, with reason and with notice, and without refund for any unused Services, for failure to abide by the TOU.
User feedback and suggestions are encouraged, with the understanding that they may be used by Transnomis freely, and without compensation or attribution.
Transnomis Privacy Statement explains how it handles information you provide to us when using the Services.
This TOU is subject to interpretation under the laws of Ontario Canada. Any dispute, claim or controversy arising will be subject to the laws and courts of Ontario Canada.
Should you file action against Transnomis relating to the Services, you must do so within 2 months of the day you became aware of the cause for such action.
Transnomis' liability in any dispute will not exceed the amount paid for the Services in the 12 months preceding the date of the action.
